Preliminary Injunction Issued

LOS ANGELES – Los Angeles City Attorney Rocky Delgadillo, the City’s chief prosecutor, today announced his Gang Division, in partnership with the Los Angeles Police Department, has secured a preliminary injunction restricting the criminal activity of six notorious criminal street gangs in South Los Angeles. Filed in Los Angeles Superior Court in September, the preliminary injunction granted today by Judge David Jaffe will severely restrict the ability of six South Los Angeles gangs from engaging in criminal and nuisance activities within the established Safety Zone as defined as a 13.2 -square mile area covering territory bounded by Washington Boulevard to the north, San Pedro and Alameda Street to the east, Vernon and San Pedro Street to the northwest and Manchester Avenue to the south. The Florence-Pueblo Del Rio Safety Zone is believed to be the largest in the City and includes the territories of six notorious street gangs: All for Crime, Barrio Mojados, Blood Stone Villains, Florencia 13, Oriental Boys and Pueblo Bishops. LAPD gang experts describe three of the gangs as primarily African-American, two Latino and one Asian. All are believed by law enforcement to be formally and informally aligned and “blood gang” affiliated due to their use of similar anti-Crip gang graffiti vandalism. The proposed Safety Zone will allow law enforcement to address the combined criminal behavior of all six street gangs and their members. Terms of the preliminary injunction include many of the standard gang injunction provisions , including limiting the gang’s ability to associate in public with other members, intimidate witnesses, to sell or possess drugs or to possess weapons or graffiti tools. The injunction includes more than 300 law enforcement declarations and more than 200 pages of expert declarations regarding the long-standing criminal activity of each of the six gangs named in the injunction, including terrorizing members of the community through assaults, threats, graffiti vandalism, trespassing, loitering on public streets as well as continued coordination with each other to protect their claimed territory from encroachment by rival gangs. DELGADILLO According to law enforcement officials, the six gangs operating within the Safety Zone have extensively used neighborhoods claimed as territory for nuisance activity including the sale of narcotics such as cocaine, heroin, methamphetamine, and marijuana. Members of the six named gangs are regularly known to use weapons and violence to facilitate the drug trade within their claimed territories. Gang Injunctions are widely recognized by law enforcement as an extremely useful tool in reducing gang activity in Safety Zones. Crucial components in aiding the effectiveness of gang injunctions include innovative probationary conditions and a partnership with L.A. County Sheriff Lee Baca to ensure gang members jailed for injunction violations serve their full term. To supplement the injunctions, Delgadillo has sought and obtained anti-gang legislation as part of his comprehensive anti-gang plan. Assembly Bill 1013, which was signed into law by Governor Schwarzenegger last fall, provides city prosecutors and City Attorneys in certain cities with the ability to protect innocent residents by evicting tenants who are either in possession of illegal weapons or are illegally possessing weapons and ammunition. Senate Bill 1126, which was signed in to law by Governor Schwarzenegger this summer allows City Attorneys to bring civil actions for damages against the leaders of viole nt criminal street gangs and to help victims of gang violence. To further enhance the crime prevention aspects of gang injunctions, City Attorney Delgadillo, working together with the LAPD and the City Council, has also established the nation’s first Gang Injunction Removal Process, which is currently in place in all the gang injunction Safety Zones in the City. The Removal Process is a confidential process that affords persons an exit strategy from gang membership so long as they abide by the law. Since taking office in July 2001, City Attorney Delgadillo has utilized injunctions as an effective tool for law enforcement and prosecutions, adopting and adapting conditions specific to each gang. If granted by the Court as proposed, the Florence Pueblo Del Rio Injunction would increase the total number of gang injunctions from eight to 38, covering more than 63 gangs and more than 84 square miles of claimed gang territory in Los Angeles.
